How to get a divorce ? Technically, the forms of divorce are the same as in France. However, given the distance, you and your lawyer may need to consider using one or the other of the existing forms according to your personal needs.
Indeed, it is possible to choose the form of divorce according to, not the degree of disagreement of the spouses, but their specific needs: travel difficulties, financial problems, degree of trust existing between the spouses...
You should therefore consult with your lawyer about the form of divorce that best suits you and manage your procedure remotely with him (email, fax, telephone...).
Children and distance
The general rules concerning children in divorces apply, however, if the two spouses live far from each other and have children in common, then there are specific problems of access and accommodation and parental authority.
- Parental authority : given the remoteness and legislation of some countries, parental authority cannot sometimes be joint. It is therefore often granted to the parent with whom the child resides.
- Visiting and accommodation rights : given the remoteness, there can be no question of regular regular visiting and accommodation rights. Depending on the distance, means of transport, the age of the children, their possible fatigue and even the cost of travel, visiting and accommodation rights during the year will be reduced (or even zero) and increased during the holidays (up to the totality of the summer holidays for example). In addition, the cost of the trip may be shared between the parents, or even borne entirely by one of the parents, depending on their financial means and the origin of the distance.
